1. Introduction & Acceptance
These Terms of Service ("Terms") govern your access to and use of the services provided by Militant.AI ("we", "us", or "our"). By accessing or using our services, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not access or use our services. We may modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of our services after any modifications constitutes your acceptance of the modified Terms.
Our services are intended for users who are at least 18 years of age. By using our services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
If you are registering for or using our services on behalf of an organisation, you are agreeing to these Terms for that organisation and warranting that you have the authority to bind that organisation to these Terms. In that case, "you" and "your" will also refer to that organisation.
If you have entered into a separate written agreement with Militant.AI for use of our services, the terms and conditions of such other agreement shall prevail over any conflicting terms or conditions in these Terms with respect to the services specified in such agreement.
2. Description of Services
Militant.AI provides the following services:
- Digital Products: AI integration guides and downloadable content designed to help businesses integrate AI into their operations
- Consultation Services: Business-to-business consultation services, including AI workflow audits and implementation guidance
- Research Content: Research articles, essays, and insights related to AI and its practical applications (publicly available)
- File Storage: User file upload and storage capabilities for managing your documents and resources
- Newsletter: Email newsletter subscriptions providing updates and insights (free service)
- Account Services: User account management and authentication services
You agree that your purchases and/or use of our services are not contingent on the delivery of any future functionality or features, or dependent on any oral or written public comments made by Militant.AI or any of its affiliates regarding future functionality or features.
We may offer additional services in the future, including subscription-based services. If we introduce subscription services, we will update these Terms to include specific terms and conditions for those services.
3. User Accounts
To access certain features of our services, you may be required to create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorised use of your account
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must not share your account credentials with any third party or allow any third party to access your account. You must not transfer or assign your account to any other person.
You are solely responsible for ensuring that your use of our services complies with all applicable laws, regulations, and third-party rights. You are responsible for taking appropriate steps to secure and protect your account and your content, including setting up and maintaining proper configuration of our services, using encryption where applicable, and ensuring that any content you upload does not violate any laws or infringe any third-party rights.
We reserve the right to suspend or terminate your account at any time if we believe you have violated these Terms or engaged in any fraudulent, abusive, or illegal activity.
4. Subscription Terms (Future Services)
Subscription services are not currently available. If we introduce subscription services in the future, we will update these Terms to include specific terms and conditions, including:
- Billing cycles and recurring charges
- Payment methods and processing
- Cancellation policies and procedures
- Refund policies and procedures
- Trial periods (if applicable)
- Automatic renewal terms
We will notify you of any changes to these Terms when subscription services become available.
5. Digital Products
We offer digital products, including AI integration guides and downloadable content. When you purchase a digital product:
- You receive a non-exclusive, non-transferable licence to access and use the product for your personal or business use
- You may download the product subject to any download limitations we specify
- You must not share, resell, redistribute, or otherwise make the product available to third parties
- You must not reverse engineer, decompile, or disassemble the product
We reserve the right to modify, update, or discontinue any digital product at any time. We may provide updates to digital products, but we are not obligated to do so.
All digital products are subject to Australian Consumer Law guarantees. If a digital product is not as described, is defective, or does not meet consumer guarantees, you may be entitled to a refund or replacement under Australian Consumer Law.
6. Consultation Services
We offer business-to-business consultation services, including AI workflow audits and implementation guidance. When you book a consultation service:
- You agree to the service description, deliverables, and pricing as communicated at the time of booking
- Pricing may be inclusive or exclusive of GST (Goods and Services Tax) as specified
- You agree to provide accurate information necessary for us to deliver the service
- Service delivery timelines will be communicated at the time of booking
All consultation services are subject to Australian Consumer Law guarantees. Services must be provided with due care and skill, be fit for purpose, and match their description. If a service does not meet these guarantees, you may be entitled to a refund or remedy under Australian Consumer Law.
Specific satisfaction guarantees or refund policies for consultation services will be clearly communicated at the time of service booking. Any additional terms specific to a particular service will be provided in writing before the service commences.
Unless otherwise agreed in writing, intellectual property in deliverables created as part of consultation services remains with Militant.AI, and you receive a licence to use the deliverables for your business purposes.
7. Payment Terms
All payments for our services are processed through a secure third-party payment processor. By making a purchase, you agree to:
- Provide accurate payment information
- Authorise us to charge your payment method for the amount specified
- Pay all applicable fees, including GST where applicable
We accept payment by credit card, debit card, Apple Pay, and Google Pay. All prices are in Australian Dollars (AUD) unless otherwise specified. GST (Goods and Services Tax) will be added where applicable as required by Australian law.
If a payment fails, we may suspend or cancel your order or service. You are responsible for any fees charged by your payment provider. We reserve the right to change our prices at any time, but price changes will not affect orders already placed.
Chargebacks and payment disputes are subject to the terms and conditions of your payment provider. We reserve the right to dispute any chargeback or payment dispute and to take appropriate action to recover amounts owed.
8. User Content and File Uploads
Our services may allow you to upload, store, and manage files. When you upload content:
- You retain ownership of your content
- You grant us a licence to store, process, display, reproduce, adapt, modify, and distribute your content as necessary to provide our services, including processing through AI systems and creating derivative works for service delivery purposes
- You are responsible for ensuring your content does not violate any laws or third-party rights
- You must not upload content that is illegal, harmful, infringing, defamatory, or violates any third-party rights
You acknowledge and agree that you assume the risk in using our services and uploading content, and that you are solely responsible for establishing such procedures for data backup, virus checking, and security as you consider necessary. We are not responsible for any loss or corruption of your content, and you are responsible for maintaining backups of your content independently of our services.
We reserve the right to remove any content that violates these Terms or that we determine is inappropriate, harmful, or illegal. We may also remove content if we receive a valid takedown request or court order.
We may impose storage limitations and reserve the right to delete content that exceeds these limitations or that has been inactive for an extended period.
9. Intellectual Property
All content, features, and functionality of our services, including but not limited to text, graphics, logos, images, software, and the design and layout of our services, are owned by Militant.AI or our licensors and are protected by Australian and international copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of our services or included software, nor may you reverse engineer or attempt to extract the source code of that software, except as expressly permitted by law or with our written permission.
The "Militant.AI" name and logo are trademarks of Militant.AI. You may not use our trademarks without our prior written permission.
You retain ownership of any content you upload to our services. By uploading content, you grant us a non-exclusive, worldwide, royalty-free licence to use, store, process, display, reproduce, adapt, modify, and distribute your content as necessary to provide our services, including but not limited to processing content through AI systems, creating derivative works for service delivery purposes, and enabling third-party service providers to perform their functions.
10. Prohibited Uses
You agree not to use our services:
- For any illegal purpose or in violation of any laws or regulations
- To transmit any malicious code, viruses, or harmful software
- To attempt to gain unauthorised access to our services, systems, or networks
- To reverse engineer, decompile, or disassemble any part of our services
- To spam, harass, or abuse other users or third parties
- To impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity
- To scrape, crawl, or use automated means to access or collect data from our services without our written permission
- To interfere with or disrupt our services or servers or networks connected to our services
- To use our services in any manner that could damage, disable, overburden, or impair our services
We reserve the right to investigate and prosecute violations of these Terms to the fullest extent of the law. We may involve and cooperate with law enforcement authorities in prosecuting users who violate these Terms.
11. Disclaimers and Limitations of Liability
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, except as required by law. We do not warrant that our services will be uninterrupted, error-free, or free from viruses or other harmful components.
To the maximum extent permitted by law, we exclude all representations, warranties, conditions, and terms that are not expressly set out in these Terms, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. However, nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term, that cannot be excluded, restricted, or modified under Australian Consumer Law.
Under Australian Consumer Law, you are entitled to certain guarantees, including that services will be provided with due care and skill, will be fit for purpose, and will match their description. These guarantees cannot be excluded.
To the maximum extent permitted by law, our liability for any claim arising out of or relating to these Terms or our services is limited to the lesser of: (a) ten times the fees you paid us in the 12 months preceding the claim; (b) AUD $10,000; or (c) the amount you actually paid us in the 12 months preceding the claim, whichever is greater. However, nothing in this limitation excludes, restricts, or modifies any right or remedy that cannot be excluded, restricted, or modified under Australian Consumer Law.
We are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, even if we have been advised of the possibility of such damages.
We are not responsible for any third-party services, websites, or content that may be linked to or accessible through our services. Your use of third-party services is subject to the terms and conditions of those third parties.
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labour disputes, or failures of third-party service providers.
12. Indemnification
You agree to indemnify, defend, and hold harmless Militant.AI, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:
- Your use of our services
- Your violation of these Terms
- Your violation of any law or regulation
- Your infringement of any third-party rights
- Any content you upload or transmit through our services
We reserve the right to assume the exclusive defence and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defence of such claims.
13. Termination
You may terminate your account at any time by contacting us or using the account deletion features in our services. We may terminate or suspend your account immediately, without prior notice or liability, if you breach these Terms or engage in any fraudulent, abusive, or illegal activity.
Upon termination, your right to use our services will immediately cease. We may delete your account and all associated data, subject to our legal obligations to retain certain information (such as payment records for tax purposes).
All provisions of these Terms that by their nature should survive termination will survive termination, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
If you have any outstanding payments or obligations at the time of termination, you remain responsible for fulfilling those obligations.
14. Dispute Resolution
These Terms are governed by the laws of Australia. Any disputes arising out of or relating to these Terms or our services will be subject to the exclusive jurisdiction of the courts of Australia.
If you have a complaint or dispute, we encourage you to contact us first to attempt to resolve the matter informally. If we cannot resolve the matter informally, you may pursue your rights under Australian Consumer Law, including:
- Contacting the Australian Competition and Consumer Commission (ACCC)
- Seeking mediation or arbitration through an appropriate dispute resolution service
- Pursuing legal action in the appropriate Australian court
Nothing in these Terms prevents you from exercising your rights under Australian Consumer Law or from seeking remedies available under Australian law.
15. Refund Policy
All refunds are subject to Australian Consumer Law guarantees, which cannot be excluded. Under Australian Consumer Law, you are entitled to certain guarantees, including:
- Products must be of acceptable quality, fit for purpose, and match their description
- Services must be provided with due care and skill, be fit for purpose, and match their description
Digital Products: If a digital product is not as described, is defective, or does not meet consumer guarantees, you may be entitled to a refund or replacement under Australian Consumer Law. Refunds will be processed to your original payment method within a reasonable timeframe as required by law.
Consultation Services: If a consultation service is not provided with due care and skill, is not fit for purpose, or does not match its description, you may be entitled to a refund or remedy under Australian Consumer Law. Specific satisfaction guarantees or refund policies for consultation services will be clearly communicated at the time of service booking.
To request a refund, please contact us using the contact information provided at the end of these Terms. We will assess your request in accordance with Australian Consumer Law and our obligations under these Terms.
Note: Specific refund policies for each service type will be clearly communicated at the point of purchase or booking. This general policy is subject to any specific terms agreed upon at the time of purchase or booking.
16. Modifications to Services
We reserve the right to modify, suspend, or discontinue any part of our services at any time, with or without notice. We may also impose limits on certain features or restrict access to parts of our services without notice or liability.
We will notify you of any material changes to our services that may affect your use of the services. However, we are not obligated to provide notice for minor changes or updates.
If we discontinue a service that you have purchased, we will provide you with reasonable notice and, where applicable, a refund or alternative service in accordance with Australian Consumer Law.
17. Third-Party Services
Our services may integrate with or link to third-party services, websites, or content. We use third-party service providers for various functions, including payment processing, authentication, data storage, file hosting, analytics, error monitoring, and security.
We are not responsible for the availability, accuracy, or content of any third-party services. Your use of third-party services is subject to the terms and conditions and privacy policies of those third parties.
We do not endorse or assume any responsibility for any third-party services, and we will not be liable for any loss or damage caused by your use of or reliance on any third-party services.

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
By using our services, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy. Please review our Privacy Policy to understand how we handle your personal information.
19. General Provisions
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Militant.AI regarding your use of our services and supersede all prior agreements and understandings.
Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
Assignment: You may not assign or transfer these Terms or your rights or obligations hereunder without our prior written consent. We may assign or transfer these Terms without restriction.
Notices: We may provide notices to you by email, through our services, or by posting notices on our website. Notices will be effective when sent or posted.
Force Majeure: We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labour disputes, or failures of third-party service providers.
Feedback: You may choose to submit comments, ideas, or feedback about our services, including suggestions for improvements. By submitting any feedback, you agree that your disclosure is gratuitous, unsolicited, and without restriction, and that we are free to use such feedback without any additional compensation to you, and/or to disclose such feedback on a non-confidential basis or otherwise to anyone. You warrant that your feedback is not subject to any licence terms that would purport to require us to comply with any additional obligations with respect to any products or services that incorporate any of your feedback.
